Terms of Service

VisaVault is an independent application preparation and data storage tool. We help you:

• Store your passport and personal details securely
• Pre-fill and validate your e-visa application data
• Check your photos meet the official requirements using AI
• Copy your details quickly into the official government form

What we are not:

• We are not affiliated with, endorsed by, or connected to the Vietnamese government, the Vietnam Immigration Department, or any Vietnamese embassy or consulate
• We are not a visa processing agency or immigration advisory service
• We do not submit visa applications on your behalf
• We do not guarantee that any visa application will be approved
• We do not provide immigration legal advice

You enter your details into VisaVault. We validate the data for common errors (incorrect formatting, expired passports, photo quality issues). When you are ready, you use our copy-to-clipboard feature to transfer your details into the official Vietnamese e-visa application form at evisa.gov.vn. You submit the application yourself and pay the government fee directly to the Vietnamese authorities.

The government visa fee ($25 USD for single entry, $50 USD for multiple entry) is paid by you directly on the official government website. This fee is separate from and in addition to any VisaVault subscription fee.

To use VisaVault, you must:

• Be at least 18 years old
• Provide accurate, current information
• Keep your login credentials secure
• Maintain only one account per person

You are responsible for all activity on your account.

You are solely responsible for the accuracy of all information you enter into VisaVault.

While we check for formatting errors and common mistakes (such as passport expiry dates, name capitalisation, and photo quality), we cannot verify that your personal details are correct.

Specifically:

• We check that names are capitalised (as required by the Vietnamese form) but we cannot verify they match your passport
• We check that passport expiry dates are at least 6 months from your entry date but we cannot verify the passport number is valid
• Our AI photo checker assesses image quality (lighting, background, face detection) but the final acceptance of photos is determined by Vietnamese immigration authorities
• We flag potential issues but the final responsibility for submitting accurate information rests with you

An application may be rejected by the Vietnamese government for reasons outside our control, including but not limited to changes in immigration policy, security concerns, or issues with your travel history.

VisaVault uses artificial intelligence (powered by Anthropic's Claude) for:

• Photo quality analysis: Assessing portrait and passport scan quality against Vietnamese government requirements
• Face matching: Comparing your portrait photo against your passport photo
• Travel chatbot: Answering questions about Vietnam travel, safety, and the visa process

AI features are provided as guidance only. AI analysis may contain errors. The Vietnamese government makes all final determinations on photo acceptability and visa eligibility. Do not rely solely on AI outputs for critical decisions about your travel.

Our chatbot provides general information about Vietnam travel and visa processes. It is not a substitute for legal advice, immigration consulting, or official government guidance. For complex visa situations, consult the nearest Vietnamese embassy or consulate.

VisaVault owns all rights to the platform, software, design, and content (excluding your personal data). You retain ownership of all personal data you enter.

You may not copy, modify, distribute, or reverse-engineer any part of the VisaVault platform.

You agree not to:

• Use VisaVault for any unlawful purpose
• Submit false or fraudulent information
• Share your account with others
• Attempt to access other users' data
• Scrape, crawl, or automatically extract data from the platform
• Use the platform to facilitate immigration fraud
• Resell or commercially exploit the service without permission

We aim to keep VisaVault available 24/7 but cannot guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses arising from service unavailability, including missed visa application deadlines.

Important: Do not rely on VisaVault as your sole means of applying for a visa. Always allow sufficient time before your intended travel date, and have a backup plan (such as applying directly on evisa.gov.vn) in case of service interruption.

To the maximum extent permitted by law, VisaVault and its operators shall not be liable for:

• Rejected, delayed, or unsuccessful visa applications
• Errors in data you have entered, even if our validation did not flag them
• Changes to Vietnamese immigration law, policy, or procedures
• Loss of travel bookings, flights, accommodation, or other expenses arising from visa issues
• Actions or decisions of the Vietnamese government, immigration officers, or border authorities
• Any indirect, incidental, consequential, special, or exemplary damages
• Loss of data beyond our reasonable control (force majeure, third-party provider failures)

Our total liability to you for any claims arising from or related to the service shall not exceed the amount you have paid to VisaVault in the 12 months preceding the claim.

This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for fraud or personal injury caused by negligence.

VisaVault integrates with third-party services including:

• Supabase (data storage and authentication)
• Stripe (payment processing)
• Anthropic (AI photo analysis and chatbot)
• Booking.com, Agoda, Trip.com (affiliate booking referrals)

We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

These terms are governed by the laws of Queensland, Australia. Any dispute arising from these terms or your use of the service shall be resolved as follows:

1. Negotiation: We will try to resolve it directly within 30 days
2. Mediation: If negotiation fails, through mediation in Queensland
3. Courts: If mediation fails, in the courts of Queensland, Australia

You agree to submit to the exclusive jurisdiction of the courts of Queensland.

We may update these terms from time to time. For material changes, we will:

• Notify you by email at least 30 days before the changes take effect
• Post the updated terms with a new “Last updated” date
• If you continue to use the service after the changes take effect, you accept the new terms

By you: You can delete your account at any time from your settings page. This will permanently delete all your data.

By us: We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation.

Upon termination, your right to use the service ceases immediately. Sections 10-15 survive termination.
